These Terms govern your use of the Carry the Torch website. By using the site, you agree to these Terms. If you do not agree, please do not use the site.

"Carry the Torch," "the Organization," "we," "us," and "our" refer to Carry the Torch, a Texas nonprofit corporation. "You" and "your" refer to anyone who accesses or uses our website (and any subdomains, the "Site").

By accessing or using the Site, you agree to these Terms of Service and to our Privacy Policy. We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.

You may not reproduce, modify, distribute, transmit, display, perform, license, or create derivative works from any content on the Site without our prior written permission, except as expressly permitted under applicable copyright law (such as fair use).
5. Donations
Donations made through or in connection with the Site are processed by third-party payment processors. By making a donation, you authorize the processing of that donation and agree to the terms of the applicable payment processor.
Donations are generally non-refundable. Once a donation is processed, it is considered a charitable gift to the Organization. We may, in our sole discretion, refund donations made in error (for example, duplicate transactions or incorrect amounts) if you contact us promptly. 6. Newsletter and Communications
If you subscribe to our newsletter or other communications, you may unsubscribe at any time by clicking the unsubscribe link in any message we send or by contacting us. We will continue to send transactional communications (such as donation receipts) as required by law.

The Site may contain links to third-party websites or services that are not owned or controlled by Carry the Torch. We are not responsible for the content, policies, or practices of any third-party site. You access third-party sites at your own risk.

10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CARRY THE TORCH, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU DONATED TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Carry the Torch and its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy and Donor Disclosure, constitute the entire agreement between you and Carry the Torch regarding your use of the Site.
